1. Agreement to Terms

By accessing or using www.themomshelper.com or any service offered by The Mom’s Helper LLC (“we,” “us,” or “our”), you agree to comply with and be bound by these Terms, Refund, and Payment Policies.
These terms govern all transportation, group, and rental services offered by The Mom’s Helper LLC. If you do not agree, please discontinue use of our services immediately.

2. Services Offered

The Mom’s Helper LLC proudly provides:

  • Student Transportation: Recurring and school-year transportation for enrolled students.

  • Group Transportation: Charters and event transportation for families, schools, and organizations.

  • Van Rentals: Short- and long-term vehicle rentals for families, individuals, and businesses.

We serve Dallas, Frisco, McKinney, Melissa, Farmersville, Rockwall, Fate, Duncanville, DeSoto, Richardson, Plano, and surrounding areas.

All services are subject to scheduling, driver, and vehicle availability, and adherence to these terms.

3. Payments & Billing

  • All payments must be made in advance before service begins.

  • Student transportation payments are due each Sunday by 11:59 PM for the upcoming week unless otherwise arranged.

  • Parents may choose to pay weekly, bi-weekly, or monthly.

  • Late payments incur a $15 per day fee beginning the day after the due date and may result in immediate suspension of service until the balance is paid in full.

  • Continued late or missed payments may result in permanent removal from service.

Accepted payment methods:

  • No-fee options: Zelle, Venmo, Cash App

  • Credit Card or PayPal: Accepted but subject to third-party processing fees (typically 3–4%)

  • Returned or failed payments: Subject to bank or processor return fees plus the balance due.

4. Refund & Cancellation Policy

  • All payments and registration fees are non-refundable under all circumstances.

  • No credits or refunds will be issued for missed days, absences, illness, vacations, or schedule changes.

  • Payment remains due during school breaks, holidays, and absences since your seat or service slot is held exclusively for your family.

  • A two-week written cancellation notice must be emailed to support@themomshelper.com.

  • Cancellation is effective two full weeks after the written notice date unless otherwise confirmed in writing.

  • Failure to provide timely written notice will result in billing for the two-week period following the notice, plus any unpaid balances.

  • Text messages, calls, or social media messages are not valid forms of cancellation.

5. Chargebacks & Disputes

  • Customers agree to contact The Mom’s Helper LLC directly before filing any dispute or chargeback.

  • Filing a chargeback on a valid payment is considered fraudulent use of services and a breach of contract.

  • If a chargeback or dispute is filed, The Mom’s Helper LLC reserves the right to recover:

    • The full disputed amount

    • All processor and bank fees

    • An administrative recovery fee of $75–$150 per occurrence

    • Collection and/or legal costs

  • Customers with unresolved chargebacks will have all services permanently terminated and be ineligible for future bookings.

6. Missed Days, Breaks, and Holidays

  • Transportation operates on a recurring basis during the school year.

  • Payment is required for all scheduled periods, even during school breaks or when the student is absent.

  • Missed days are not eligible for make-up or credit.

  • Seats cannot be “held” or paused temporarily without full payment.

7. Rider Conduct & Damages

A. Transportation & Group Services

  • Riders must maintain respectful and safe behavior at all times.

  • Parents are financially responsible for damages caused by their child, including vandalism, spills, or seat damage.

  • A minimum $150 cleaning fee applies for food, drink, or bodily fluids.

  • The Mom’s Helper LLC reserves the right to suspend or remove riders for unsafe or disruptive conduct.

B. Van Rentals

  • Renters are responsible for the condition of the vehicle while in their possession.

  • A minimum $250 cleaning/damage fee applies for smoking, strong odors, or interior neglect.

  • Renters are liable for:

    • All accidents, citations, and towing during the rental period

    • Returning the vehicle with a full fuel tank

    • Avoiding overloading, off-road use, or neglect of warning lights

  • Additional mileage beyond the included allowance is billed at $0.75 per mile.

8. Non-Payment & Service Suspension

  • If payment is not received by the due date, service may be suspended immediately.

  • After 7 days of non-payment, the account may be terminated and referred to collections.

  • Routes, seats, and rentals will not be reserved or reinstated until payment is received in full.

9. Weather, Safety & Medical Emergencies

  • Service may be delayed, rescheduled, or canceled due to unsafe road conditions, severe weather, or emergencies.

  • Missed days due to weather or safety concerns are not refundable.

  • In a medical emergency, The Mom’s Helper LLC may contact emergency services and/or the parent listed on file.

  • All emergency costs are the responsibility of the parent or guardian.

10. Vehicle Substitution & Route Adjustments

The Mom’s Helper LLC may assign alternate vehicles, adjust routes, or provide substitute drivers to ensure continuity of service when necessary.
Availability of specific drivers or vehicles is not guaranteed.

11. No Supervision After Drop-Off

Our responsibility ends once a student is safely dropped off at their designated location and visible entry to school, home, or guardian has been confirmed.

12. Indemnification

You agree to indemnify, defend, and hold harmless The Mom’s Helper LLC, its employees, drivers, and affiliates from any claims, losses, damages, or legal expenses arising from your or your child’s participation in our services.

13. Force Majeure (Acts of God)

The Mom’s Helper LLC shall not be held liable for any failure or delay in performance caused by events beyond its control, including natural disasters, weather, accidents, public emergencies, or government restrictions.

14. Collections & Legal Enforcement

In the event of non-payment or chargeback, you agree to pay all collection costs, legal fees, and court expenses incurred by The Mom’s Helper LLC to recover the outstanding balance.
Returned checks and failed payments are subject to a $50 returned payment fee plus any bank charges.

15. Electronic Consent & Communication

By using our website or completing registration online, you consent to receive communications, invoices, and notices electronically.
Submitting a payment or clicking “I agree” constitutes your legal signature and acceptance of these terms.

16. Right to Update or Refuse Service

The Mom’s Helper LLC reserves the right to update prices, terms, or policies without prior notice and to refuse or discontinue service to any customer for safety, non-payment, or misconduct.

17. Governing Law

These Terms are governed by and interpreted under the laws of the State of Texas.
Any disputes shall be resolved exclusively in the courts of Collin County, Texas.

18. Intellectual Property

All logos, designs, photos, and content are the property of The Mom’s Helper LLC and may not be copied or reused without written consent.
